Authorised Drivers
Only those persons named as authorised drivers on the Rental Agreement shall be permitted to drive the vehicle(s) supplied under this agreement, and then only if those persons hold a current full drivers licence appropriate for the vehicle at the time that they are driving the vehicle.

The term of the Hire and Vehicle Hire Charges
All rates include GST
The vehicle may not be driven outside the area designated on the Rental Agreement.

Extensions
If you are wanting to extend your hire with us please phone to extend the rental, and if this is possible we will always oblige. Some vehicles may not be able to be extended due to availability and you will need to check with the particular depot you collected your vehicle from. Vehicle hire charges are non-refundable and non-transferable. In the event that the hirer cancels or voids the agreement, or returns the vehicle earlier than stated in the agreement, no refund applies.

Acceptance of Rental Terms and Conditions
The hirer agrees to be bound by all of the Terms and Conditions of the rental agreement. The hirer acknowledges that he or she is fully and absolutely liable for any excess owing due to damage of the rental vehicle irrespective of fault.

Use of the Vehicle
The hirer must not use or allow the vehicle to be used for the transport of passengers for hire or reward. Only drivers shown on the front of the contract are covered under the terms of the hire contract – unauthorised drivers or underage drivers will void all coverage afforded under the contract.

Smoking
There is to be no smoking in any of the hire vehicles – if detected a cleaning fee will apply.

Mechanical Issues and Warning Lights
If any warning light appears on screen or if the vehicle requires mechanical attention the driver must stop driving and notify Ace Rent A Car immediately.

The hirer shall not arrange or undertake any repairs or salvage without Ace Rent A Car prior authority except to the extent that repairs or salvage are necessary to prevent further damage to the vehicle or to other property. Ace Rent A Car will not pay for relocation or living expenses due to issues with the vehicle.

Ace Rent A Car gives no express warranties in relation to the vehicle. Certain conditions and warranties are imported by statute, whether Commonwealth or State, which cannot be excluded, restricted or modified, such as those under the Trade Practices Act 1974. Where Ace Rent A Car is permitted to limit its liability under those statutes for breach of any implied condition or warranty, Ace Rent A Car limits its liability to replacement, repair or re-supply of the vehicle. All warranties, conditions and obligations which may otherwise be implied are expressly excluded by this agreement in their entirety.

Accidents
In the event of an accident the hirer shall notify Ace Rent A Car as soon as practicable possible and gain full details of the other parties and any other witnesses and not admit liability or fault at any stage. The hirer will not allow the vehicle to be towed by a 3rd party or authorise any repairs without the written permission of Ace Rent A Car.

In the unlikely event that an accident occurs and the vehicle becomes unfit to drive, Ace Rent A Car or its agents will make no refund for the unused hire period (including optional cover payment if applicable) and the supply of a replacement vehicle shall be at AceRent A Car sole discretion. Ace Rent A Car shall not be responsible for the cost of transporting the hirer and any accompanying passengers away from the accident location.

Hirer’s Liability for Damage
The hirer is liable for any damage up to the amount specified in the contract irrespective of fault- once fault has been determined then the hirer may be refunded the damage amount if the other party is at fault and has paid all outstanding monies to their insurer. The hirer’s liability for damage applies to each separate accident or incident, not each rental.

Hirer’s Liability for Cleaning Charges
The vehicle is to be returned in a manner that would not require excessive cleaning or de-odorising, the hirer is liable for the total cost of the cleaning.

Fuel
The hirer is responsible for the cost of fuel used during the hire and the vehicle needs to be returned with the same level of fuel that it left the depot with – otherwise a fee will be charged.

Personal Injury, Personal Property and Storage of Property
Any property or belongings of the hirer are not covered by any Ace Rent A Car insurances the company or its agents will not accept any liability for:

• Personal injuries sustained during the rental;
• Damage or loss of the hirer’s personal property;
• Property belonging to any other person which is carried in the vehicle.
